Record U.S. tariff award over Airbus aid could fuel trade tensions

BRUSSELS/PARIS (Reuters) – Transatlantic trade ties face renewed disruption this week when global arbiters are expected to grant the United States a record award allowing it to hit European imports with billions of dollars of tariffs in a long-running aircraft subsidy dispute.

The World Trade Organization (WTO) has found that both European planemaker Airbus <EADSY> and its U.S. rival Boeing <BA> received billions of dollars of illegal subsidies in a pair of cases that have run for 15 years.

Both sides have threatened tariffs after the Geneva body found neither adhered fully to its findings. However, the United States has a head start, with the European Union having to wait until early in 2020 to hear what level of retaliation it can exact over Boeing.

The WTO is expected this week to reveal the amount of EU goods the United States can target. People familiar with the case say the three-person tribunal is expected to award it around $7.5 billion, a record for the 24-year-old watchdog.

Such retaliation rights are rarely granted by the WTO – most parties reach settlements – and in many cases complainants do not exercise their rights. The United States though has indicated it will target EU goods to the fullest extent.

It has already published a $25 billion list from which it will pick items to target from aircraft and aerospace parts to wine, cheese and luxury goods.

The WTO award in the world’s largest corporate trade dispute could fuel already strained trade tensions, diplomats say.

EU manufacturers are already facing U.S. tariffs on steel and aluminum and a threat from U.S. President Donald Trump to penalize EU cars and car parts. The EU has in turn retaliated.

Trade talks between the two, designed to ease tensions and ward off the threat of a tit-for-tat tariff war, have not gone well. The two sides have made some progress on regulatory cooperation, but a proposed deal to reduce duties is stuck, with Washington saying agriculture should be included and Brussels insisting it cannot.

The Trump administration has concluded that tariffs were effective in bringing China to the negotiating table over trade, and in convincing Japan to open its agricultural market to U.S. products. Washington is unlikely to skip the opportunity to implement tariffs in the case over aircraft subsidies, according to current and former U.S. officials.

Airbus has said this would lead to a ‘lose-lose’ trade war.

Some U.S. airlines have urged the administration not to go ahead with the tariffs, saying they could lead to layoffs.

NO SETTLEMENT IN SIGHT

The parties could still theoretically resolve the issue and stave off sanctions, but both sides accuse the other of failing to respond to invitations to reach a negotiated settlement.

U.S. officials say the decision about next steps will be up to U.S. President Trump.

The EU cannot retaliate immediately to any tariffs as it did following the U.S. imposition of metal tariffs in 2018.

It can either wait until a pronouncement in the parallel Boeing case or possibly revive an existing right to hit $4 billion of U.S. imports in a WTO dispute over U.S. tax breaks for exports, even though the two sides settled in 2006. Such a move would likely be strongly contested by Washington.

EU trade chief Cecilia Malmstrom has urged Washington to hold off sanctions and seek an overall deal on aircraft support, but Washington has shown no sign it wants to talk.

A U.S. government official said Washington has been willing since the very beginning to negotiate a solution, but that the EU gave more support to Airbus rather than fixing the problem.

EU-U.S. trade relations are likely to be a major focus in Brussels during a parliamentary hearing of the next trade commissioner, Irishman Phil Hogan, on Monday, and of national trade ministers meeting on Tuesday.

American Airlines Mechanic Charged with Alleged Sabotage of Plane Amid Union Dispute

WASHINGTON, Sept 5 (Reuters) – An American Airlines mechanic was on Thursday charged with purposely damaging an aircraft in July amid a dispute between the airline and its mechanics union involving stalled contract negotiations.

Pilots of a flight from Miami to Nassau, Bahamas on July 17 aborted take-off plans after receiving an error message involving the flight computer, which reports speed, pitch and other data, according to a criminal complaint filed in U.S. District Court of Southern Florida.

It said after returning to the gate for maintenance, a mechanic discovered a loosely connected pitot tube that measures airspeed and connects directly to the flight computer.

A later review of video surveillance footage before the flight captured “what appears to be the sabotage of the aircraft” by a man walking with a limp, the complaint said.

When suspect Abdul-Majeed Marouf Ahmed Alani was interviewed, he told law enforcement he was upset at the stalled contract between the union and American, which he said had affected him financially, according to the complaint. It said Alani claimed to have tampered with the aircraft to cause a delay or have the flight canceled in anticipation of obtaining overtime work.

Unions have complained that American is trying to outsource more maintenance jobs, a move American has indicated is necessary to cover increased wages.

A U.S. federal court last month issued a permanent injunction against American’s mechanics union, which the airline had accused of illegal slowdowns it said had devastated its operations during the peak summer travel season.

A spokesman for American said the airline had an “unwavering commitment” to safety and security and had placed passengers on the July 17 flight subject to the criminal complaint on another plane to get to their destination.

“At the time of the incident, the aircraft was taken out of service, maintenance was performed and after an inspection to ensure it was safe the aircraft was returned to service,” the spokesman said. “American immediately notified federal law enforcement who took over the investigation with our full cooperation.”

The Miami Herald reported that Alani is set to make an initial court appearance on Friday. Court records did not indicate if Alani had an attorney.

The U.S. federal court order last month prohibits employees from “calling, permitting, instigating, authorizing, encouraging, participating in, approving, or continuing any form of disruption to or interference with American’s airline operations,” including a refusal to accept overtime or complete any maintenance repairs in the normal course of work.

Interjet Denies That it’s in Technical Bankruptcy

IT IS NOT TRUE THAT INTERJET IS IN TECHNICAL BANKRUPTCY

  • The handling of the information published by Bloomberg is irresponsible.
  • The news agency made a misinterpretation of the judicial review filed by Interjet in its legal dispute with the Internal Revenue Service of Mexico.

Mexico City, August 30, 2019.- Interjet categorically denies that it is bankrupt as published by the Bloomberg news site. The news agency made a misinterpretation of the constitutional claim filed by the airline in the dispute that it holds with the Internal Revenue Service of Mexico (SAT).

Bloomberg had access to a file that by law is not supposed to be public. In a judicial dispute, the only persons entitled to consult the records are those authorized by the parties involved in the trial.

At no time, the company has recognized the existence of a technical bankruptcy as this media outlet states.

It should be noted that bankruptcy can only be declared by court order, and cannot be self-imposed by the debtor or any other entity. It’s a legal process through which the insolvency of a company has to be proved. This is not the case of the current situation of Interjet because the company continues paying its debts.

Bankruptcy cannot be declared by a company or by an individual, and this determination corresponds to a court.

Interjet reserves its right to pursue any available legal actions against Bloomberg.

Lufthansa, Deutsche Bahn Settle Air Cargo Dispute

German flag carrier Lufthansa and German national railway Deutsche Bahn have reached agreement on a long-festering dispute concerning an air cargo cartel.

The settlement was announced Aug. 26, although details are being kept confidential by mutual agreement.

The settlement ends a dispute before the Cologne regional court that has been ongoing since 2013.

Settling parties are DB Barnsdale, a wholly owned subsidiary of Deutsche Bahn, and Lufthansa Group member companies Lufthansa Cargo, Swiss International Air Lines and Deutsche Lufthansa.

Southwest Ends Mechanics Dispute as American’s Heats Up

CHICAGO, May 21 (Reuters) – Southwest Airlines Co’s mechanics union said on Tuesday its members had overwhelmingly voted to ratify a tentative contract agreement with the airline, ending seven years of labor negotiations fraught with legal disputes and flight disruptions.

The agreement came a day after rival U.S. carrier American Airlines Group Inc said it was filing a lawsuit against its own mechanics alleging an illegal slowdown aimed at disrupting operations to improve their position in labor talks, which began in 2015.

Analysts have highlighted labor issues as a main concern for airlines this year.

Mechanics at both American and Southwest have complained that the airlines are moving to outsource maintenance work that has traditionally been done in-house.

In a statement on its website, the Aircraft Mechanics Fraternal Association, which represents around 2,500 Southwest mechanics, said about 95 percent of its members had voted to accept the labor agreement.

Separately on Tuesday, American Airlines’ mechanics association said it was “ready and willing” to negotiate a fair contract.

“We would much prefer to be at the negotiating table than in a legal battle brought on by American,” the TWU-IAM Association said in a statement.

Southwest CEO Says Mechanics Deserve New Contract

CHICAGO (Reuters) – Southwest Airlines Co’s mechanics, who have been in labor contract talks for more than six years, deserve a new deal that makes them among the best paid in the airline industry, but the low-cost U.S. carrier needs “more supplier flexibility” in return, the company’s chief executive said.

The labor dispute, one of the biggest to hit a top-four U.S. airline in more than a decade, has escalated with Southwest’s daily out-of-service aircraft doubling, forcing the carrier to cancel hundreds of flights since Feb. 15.

Southwest CEO Gary Kelly in an email to the company’s employees acknowledged the company was “in a period of tension and turmoil” regarding the out-of-service aircraft. Reuters obtained a copy of the email late Friday.

Kelly said the mechanics deserve a new contract and pointed out that the deal the mechanics voted down last year would have made those workers the highest paid in the industry. He said current talks offer the opportunity to offer even higher pay with no impact on job security “in exchange for more supplier flexibility.”

Southwest already outsources the majority of heavy maintenance work, such as scheduled engine repairs, to external suppliers, but wants the option to send more scheduled maintenance abroad in order to fund compensation increases. The change would not affect the kind of work currently handled by its mechanics, a Southwest spokesman said.

Officials with the Aircraft Mechanics Fraternal Association (AMFA), which represents about 2,400 Southwest mechanics and has been in contract talks with management since 2012, could not immediately be reached to comment on Saturday.

The union has disputed the notion that the maintenance issues are driven by the labor dispute, pointing out the company has the lowest mechanic-to-aircraft ratio of any major carrier.

In a Friday email to its members, the union rejected the company’s assertion that the maintenance issues were a job action and said mechanics should not allow themselves to be pressured to ignore safety or mechanical issues with a plane.

“If you feel you are being pressured to disregard aircraft damage or shortcut the manuals, then let your airline representative know of such threats,” union national director Bret Oestreich said in the email. “But do not get baited into acts of defiance that will be characterized as insubordination.”

Flights by Southwest accounted for more than a third of 777 U.S. cancellations between Friday and Saturday, according to FlightAware.com.

Bombardier CSeries Jet Gets Trade dispute Victory

On Friday, the U.S. International Trade Commission handed down its decision in a long-running trade dispute between Boeing (NYSE: BA) and Bombardier (NASDAQOTH: BDRBF). Most observers had been expecting Boeing to prevail over its Canadian rival. Not only does the ITC tends to be biased toward U.S. companies, but Bombardier also had refused to answer some of the Department of Commerce’s questions in the ongoing case.
