Atlas Air and Southern Air Prevail in Appeals Court Ruling Against Teamsters Pilot Union

PURCHASE, N.Y., Nov. 21, 2019 (GLOBE NEWSWIRE) — Atlas Air Worldwide Holdings, Inc. (AAWW) today confirmed that its subsidiaries Atlas Air, Inc. and Southern Air, Inc. have prevailed in another legal dispute with the union that represents its pilots in ongoing negotiations, the International Brotherhood of Teamsters.

The decision by the U.S. Court of Appeals for the Second Circuit affirms a March 13, 2018, decision by the Southern District Court of New York compelling the Teamsters to arbitrate whether the merger provisions in Atlas Air and Southern Air’s collective bargaining agreements apply to the bargaining process. Today’s decision, as well as two binding decisions by arbitrators rendered in favor of both Atlas Air and Southern Air this summer, have made clear that IBT must engage in the current Atlas Air and Southern Air collective bargaining agreements’ expedited and defined process for achieving a joint collective bargaining agreement.

In a separate labor-related decision rendered in July 2019, the U.S. Court of Appeals for the District of Columbia unanimously affirmed a federal district court ruling in November 2017 that ordered the union to stop an intentional and illegal work slowdown by Atlas Air pilots in violation of the Railway Labor Act. The unanimous ruling from a three-judge panel upheld the lower-court order that blocked the union from continuing to engage in improper activities such as excessive sick calls on short notice or refusing to volunteer for open time.

“With these decisions behind us, it’s time for the union to honor its obligations under the collective bargaining agreements and these binding decisions. Specifically, the union has an obligation to produce an integrated seniority list and engage in direct bargaining for a defined and limited period of time. In ongoing negotiations, the union has yet to provide us with a comprehensive economic proposal covering pay and benefits for evaluation. We remain committed to working collaboratively with union leaders to efficiently negotiate and complete the contract,” said William J. Canada’s Largest Railroad Hit by Strike, Trudeau in Hot Seat

MONTREAL/WINNIPEG, Nov 19 (Reuters) – Thousands of workers at Canada’s largest railway went on strike for the first time in a decade on Tuesday, disrupting the shipping of commodities and sparking calls for Prime Minister Justin Trudeau’s Liberal government to intervene.

About 3,000 unionized workers of Canadian National Railway, including conductors and yardmen, hit picket lines after both sides failed to resolve contract issues at a time of softening demand for freight service. They continued talks on Tuesday in Montreal amid union concerns over fatigue, safety and ensuring that workers’ breaks are not reduced.

Canada, one of the world’s biggest exporters of farm products, relies on CN and Canadian Pacific Railway to move canola, wheat and other commodities over vast distances from western farms to ports. Crude oil shippers and the mining industry also depend on the railways.

The strike comes at an awkward time for Trudeau’s government, which relies on smaller parties to pass legislation and faces criticism from western provinces about its failures to get new oil pipelines built. Trudeau has said he is not reconvening Parliament until Dec. 5, and the government cannot start the process to force workers back on the job until then.

Andrew Scheer, leader of the Conservatives, the second-largest party in Parliament, and Alberta Energy Minister Sonya Savage each separately urged Trudeau on Twitter to recall Parliament immediately.

The Canadian mining industry, which accounts for more than half of annual rail freight revenues, depends on CN to transport supplies to company sites and products from their operations.

“This strike will result in a severe reduction or elimination of railway capacity and will trigger the closure of mines with concurrent layoffs of thousands of employees beginning in a matter of days,” said Pierre Gratton, president and CEO of the Mining Association of Canada.

“SCREECHING HALT”

Industry groups ranging from the Canadian Manufacturers and Exporters to propane and fertilizer groups said Ottawa needed to step in to limit damage to the economy.

The BC Council of Forest Industries, which represents the sector in British Columbia, expressed concerns about the disruptions caused by the strike for rail transport.

“Ninety percent of the forest products we produce are sent to export markets in North America and around the world,” Susan Yurkovich, the body’s president, said.

“A disruption of this critical transportation network will adversely impact BC forest companies at a time when we are already facing significant challenges and increasing competition from around the globe”, Yurkovich added.

CN and CP also collectively handle nearly all grain movement in Western Canada, the country’s crop belt, split roughly evenly between the railways.

The stoppage “has an impact before it even begins because companies pull back sales in anticipation of a strike,” said Wade Sobkowich, executive director of the Western Grain Elevator Association, whose members include Cargill Ltd, Richardson International and Viterra Inc.

CN’s shipments of hazardous goods such as crude are likely to come to a “screeching halt” even if the railroad’s management steps in to limit freight volumes, said Kent McDougall, chief commercial officer at Torq Energy, which loads crude oil in Western Canada onto trains operated by both CN and CP.

A strike may temporarily constrain CN’s volumes, but will not likely have a meaningful long-term impact on the company’s earnings, Credit Suisse analysts said in a research note on Monday, adding that Ottawa has historically been quick to intervene.

Shares of Montreal-based CN were down 1%, while the benchmark Canadian share index was up slightly.

Canadian Labour Minister Patty Hajdu and Transport Minister Marc Garneau said they are monitoring the CN strike situation closely after meeting with the two sides on Monday.

CN said in a statement that it was “disappointed” at the strike action. CN’s service in the United States will continue operating despite the strike.

The company said on Friday it would cut management and union jobs as it grapples with an economic slowdown.

Rail workers with the Teamsters held their last strike in 2009, when locomotive engineers walked off the job for five days, the union said.

Boeing Delivers First P-8A Poseidon to United Kingdom’s Royal Air Force

SEATTLE, Nov. 8, 2019 – Boeing [NYSE: BA] last week delivered the first of nine P-8A Poseidon maritime patrol aircraft (MPA) to the United Kingdom Royal Air Force (RAF). The United Kingdom is acquiring the multi-mission aircraft through the Foreign Military Sales process with the U.S. Navy. The P-8A Poseidon replaces the U.K.’s retired Nimrod aircraft.

Speaking to attendees at the delivery ceremony, Air Marshal Andrew Turner, deputy commander for Capability for the Royal Air Force, spoke of the “profound challenge” of enemy submarines threatening the U.K. and other nations. “P-8 is the key to solving this challenge on the surface, the sub-surface and in the waters of the North Atlantic. There is no place [for our enemies] to hide. We will make the oceans transparent and we will prevail.”

Boeing formally delivered the aircraft on Oct. 29 to the U.S. Navy during a ceremony at the Boeing Military Delivery Center in Tukwila, Wash. From Tukwila, the aircraft flew to the U.S. Navy’s Naval Air Station Jacksonville, Florida, where U.S. Navy leaders officially turn the aircraft over to the United Kingdom. At JAX, Royal Air Force crew will work with the aircraft before flying it to the United Kingdom in January 2020. All nine P-8A aircraft will be based at Lossiemouth, Scotland.

As part of a collaborative program with the U.S. Navy, pilots and maintainers from the United Kingdom’s RAF have been stationed at Naval Air Station JAX since 2012. Called “Project Seedcorn,” the arrangement has allowed RAF members to fly the P-8A with Patrol Squadron Thirty (VP-30), the Navy’s Maritime Patrol and Reconnaissance Fleet Replacement Squadron, to maintain their maritime patrol skills in advance of receiving the P-8A.

The P-8 is a long-range anti-submarine warfare, anti-surface warfare, intelligence, surveillance and reconnaissance aircraft capable of broad-area, maritime and littoral operations. In addition, the P-8 performs humanitarian and search and rescue missions around the globe.

Airbus Announces New and Expanded Capability for OceanFinder

Toulouse, 18 September 2019 – Airbus Defence and Space has released the latest version of OceanFinder, its digital maritime service to detect, identify and track collaborative and non-collaborative vessels around the globe.

First launched in 2018, OceanFinder leverages Airbus’ advanced constellation of optical and radar satellites, combined with real-time global Automatic Identification System (AIS) data, and the latest in automated analytics, to support a broad range of critical applications across defence and security, shipping, oil and gas, and insurance markets.

OceanFinder’s latest updates introduce a number of innovative features – extending the service’s capabilities in several key areas. From today, users will benefit from enhanced imagery and AIS data correlation to identify the precise location of a non-responding vessel in near real-time. This development has been combined with the latest in fully-automated detection and classification, which utilises powerful proprietary algorithms to determine a vessel’s identity in just a few seconds. Apollo and Athene to Acquire PK AirFinance From GECAS

NEW YORK, Aug. 29, 2019 (GLOBE NEWSWIRE) — Apollo Global Management, LLC (together with its consolidated subsidiaries, “Apollo”) (APO); Athene Holding Ltd. (ATH); and GE Capital, the financial services arm of GE (GE), today announced that they have entered into a definitive agreement for Apollo and Athene to purchase PK AirFinance, an aviation lending business, from GE Capital’s Aviation Services (GECAS) unit. In connection with this transaction, Apollo will acquire the PK AirFinance aircraft lending platform and Athene will acquire PK AirFinance’s existing portfolio of loans.

PK AirFinance is a leading aircraft lending business that serves airlines, aircraft traders, lessors, investors and financial institutions globally with loans to borrowers in more than 40 countries. Financial details of the transaction were not disclosed, although the $3.6 billion of PK AirFinance financing receivables that were held for sale in the second quarter of 2019 are being sold at a premium to book value in this transaction.

Spirit Airlines Looking at Airbus and Boeing Planes for Growth, Debuts WhatsApp

LAS VEGAS (Reuters) – Spirit Airlines <SAVE>, a fast-growing, low-cost U.S. carrier that flies an all-Airbus SE <EADSY> fleet, is looking at both the Airbus A321neo and a larger Boeing Co <BA> aircraft to fuel its growth, Chief Executive and President Ted Christie said on Monday.

The launch of WhatsApp support comes as a direct result of Spirit’s new partnership with LivePerson, a global leader in conversational commerce solutions. Beyond WhatsApp, the partnership also makes it possible for Spirit Guests who call to get immediate support by opting to begin a messaging conversation with Spirit representatives instead. 

These new Guest solutions will also leverage LivePerson’s new AI-powered Maven Assist capability, which recommends the optimal next actions for human agents to take, including surfacing content or suggesting virtual assistants capable of responding to a Guest’s intent. Guests will still retain the ability to message with a live representative at any time during the process to address questions, comments and situations that are best suited for a live specialist.

FreightCar America Closing its Roanoke Manufacturing Facility

  • Closure represents next step in the Company’s long-term cost and footprint reduction strategies

CHICAGO, July 22, 2019 (GLOBE NEWSWIRE) — FreightCar America, Inc. (RAIL) announced today that it has started the process to permanently close its Roanoke, Virginia manufacturing facility. The Company will retain the necessary workforce to build cars at the facility through November.

“The closure of our Roanoke facility is another next step in our ‘Back to Basics’ strategy as we continue to streamline our manufacturing footprint and match it to our future product offering,” said Jim Meyer, President and Chief Executive Officer of FreightCar America. “Reducing our fixed costs and achieving world-class output from our much larger Shoals facility have always been core pillars of our turnaround strategy.”

Meyer added, “We have spent the last two years building our talent, processes and overall capabilities at Shoals and the plant is now in a position to accept the Roanoke models and volume. This action, when complete in the first half of 2020, is expected to save approximately $5 million per year.”

Meyer concluded, “Our people at Roanoke have consistently performed above all expectations. We are extremely thankful for everything they have given the Company.”
