Rostec Ready for 737 MAX Out of Court Deal with Boeing

MOSCOW (Reuters) – A unit of Russian conglomerate Rostec said on Tuesday it was ready for an out-of-court settlement with Boeing over its order for 35 Boeing 737 MAX jets, a spokesman for Rostec’s subsidiary Avia Capital Service told Reuters.

Boeing MAX 737 jets have been grounded worldwide and airlines are cancelling multimillion contracts following crashes in October and March that killed 346 people.

Earlier on Tuesday, Rostec said its unit had filed a lawsuit in the United States to cancel its order for the 35 MAX jets. The Financial Times, which first reported the move, said Avia Capital Service gave Boeing a cash deposit of $35 million.

A spokesman for Avia Capital Service told Reuters that delivery of the jets was first scheduled for October 2019 but was moved to March 2022. The Rostec unit had paid Boeing a deposit and was suffering losses from non-delivery, he said.

“If Boeing executives show a good will, we are ready to hold talks and find a mutually-beneficial out-of-court settlement for compensation of the losses we have suffered,” he said.

He added that the jets were ordered for a number of Russian air companies, including domestic low-cost firm Pobeda, a unit of the state carrier Aeroflot.

Russia is mainly using Boeing and Airbus jets for passenger flights, with a number of domestic airlines also adding Russian-made regional Sukhoi Superjet aircraft to their fleets.

The Rostec subsidiary now wants the deposit to be returned by Boeing with interest, along with $75 million in “lost profit” and about $115 million in compensatory damages, plus “several times the amount” in punitive damages, the FT said.

Rostec declined to provide further details about the lawsuit.

Allegiant Airlines Announces Aircraft Base in the Lehigh Valley

LEHIGH VALLEY, Pa., Aug. 20, 2019 /PRNewswire/ — State and local officials joined executives from Allegiant Travel Company (NASDAQ: ALGT) today as the company announced plans to establish a two-aircraft base at Lehigh Valley International Airport (ABE) in Lehigh County, Pennsylvania. Allegiant’s growth plans in the state include creating at least 66 new, high-wage jobs.

The Las Vegas-based company is investing $50 million to establish its new base of operations, which will house two Airbus aircraft. The company, which focuses on linking travelers in small-to-medium cities to world-class leisure destinations, plans to begin its base operations at Lehigh Valley International Airport on February 12, 2020. Lehigh Valley will become the airline’s 18thaircraft base.

Avianca Advances Plan to Manage Outstanding Liabilities

BOGOTA, Colombia, July 22, 2019 /PRNewswire/ — Avianca Holdings S.A. (NYSE: AVH) today announced that, in connection with its previously announced re-profiling plan for its capital structure, the company has temporarily deferred payments on certain long-term leases and on payment of principal on certain loan obligations.  Avianca Holdings has engaged in discussions with its main strategic lenders and other creditors to establish terms that will preserve current liquidity levels and enable Avianca Holdings to advance its re-profiling plan, which is aimed at strengthening the company’s financial position. Over the last two weeks, members of Avianca Holdings’ senior management team have met with more than 50 of Avianca Holdings’ strategic lenders and other creditors with the objective of reaching an agreement on the terms and conditions of the proposed deferrals. Importantly, obligations related to Avianca Holdings’ day-to-day operations remain current, and such operations, including flight schedules and other ordinary course operations, will remain unaffected.

Avianca Holdings affirms that it is current on all existing interest obligations and that Avianca Holdings actively seeks to arrive at a mutually satisfactory agreement with its strategic lenders and other creditors for a short-term deferral of principal amortization payments, as well as extensions of its credit facilities. Avianca Holdings intends to resume scheduled principal payments once these agreements have been successfully reached, as Avianca Holdings’ proposal is for all creditors to be paid in full, including principal and interest.

In connection with its re-profiling program, Avianca Holdings today made a separate announcement regarding an exchange offer for its outstanding 8.375% Senior Notes due 2020. China Southern Airlines to receive $4 billion capital injection

SHANGHAI (Reuters) – China Southern Airlines will carry out an equity diversification plan that will involve the injection of 30 billion yuan ($4.36 billion) of capital from three investors, the firm announced on Saturday.

The Guangdong Hengjian Investment Holding Corporation, the Guangzhou Urban Construction Investment Group and the Shenzhen Penghang Equity Investment Fund will each inject 10 billion yuan into the airline, as part of the country’s efforts to diversify ownership structures among state-owned firms.

The move will significantly improve the company’s debt-to-asset ratio, generate funds for its growth and help modernize its decision-making mechanisms, the announcement said.

It will also use the funds to serve its main air transportation business, pay for construction related to China’s Belt and Road Initiative and support aviation development in cities in the southern province of Guangdong.

China Southern is one of 96 enterprises owned and administered directly by the central government. Its profits slumped nearly 50% last year as a result of rising fuel costs and a weak yuan currency.

Pioneer Railcorp Shareholders Approve Merger with BRX

PEORIA, Ill., July 19, 2019 /PRNewswire/ — Pioneer Railcorp (OTC: PRRR, “Pioneer”), a railroad holding company that owns short-line railroads and several other railroad-related businesses including a railroad equipment company and a contract switching services company, today announced that its shareholders have approved the previously announced definitive merger agreement with BRX Transportation Holdings, LLC (“BRX”), an entity formed by Brookhaven Rail Partners (“Brookhaven”), Related Infrastructure (“Related”) and Stephens Capital Partners LLC (“Stephens”). Consummation of the merger remains subject to various closing conditions, including operating performance by Pioneer within a specified working capital floor and debt ceiling.  Subject to satisfaction of the closing conditions, the transaction is expected to close in late July 2019. Upon closing of the transaction, Pioneer will become a wholly-owned subsidiary of BRX and its Class A common stock will cease trading on the OTC Markets.

TAROM Selects ATR 72-600 to Renew its Regional Fleet

Major fleet upgrade with nine modern turboprops providing increased seat capacity, lowest operating costs and best environmental performance

Toulouse, 26 June, 2019 – TAROM, the Romanian national air carrier, will introduce nine new ATR 72-600 aircraft, the market-leading product of the world’s number one regional aircraft manufacturer, into its fleet. The ATR 72-600 will be leased from NAC, the world’s number one regional aircraft lessor. Deliveries will commence in October 2019 through to 2020.  

TAROM has been very successful in its domestic market operations by using ATRs to allow it to compete with low cost carriers. This upgrade will ensure that the airline is equipped with the latest generation of turboprops burning 40% less fuel and emitting 40% less CO2 than regional jets.   

New ATRs will offer TAROM an additional 330,000 seats every year at the same operating cost as its previous seat level, improving short haul connectivity in Romania and supporting the development of local and more isolated communities. This will provide TAROM with the possibility to further expand and consolidate their position in the market.

Viking Signs Deal for Next Generation CL-515 Aircraft

PARIS, June 18, 2019––Longview Aviation Capital (“Longview”) and its subsidiary Viking Air Limited, a global leader of utility aircraft, support and services and manufacturer of the world-renowned Twin Otter, today announced a seven aircraft sales contract for six new-production CL-515 aircraft and one CL-415EAF.

The CL-515 is a newly developed, technically advanced multi-mission aerial firefighting aircraft – the next generation of the CANADAIR CL-415, the aviation industry’s benchmark amphibious aircraft and the backbone of firefighting missions around the globe. The Republic of Indonesia’s Ministry of Defense has agreed to purchase six all-new CL-515 aircraft, four of which will be delivered in “First Responder” multi-mission configuration, and two delivered in optimized aerial firefighter configuration. Boeing Invests in Services Provider Robotic Skies

Startup manages maintenance, inspection and alteration services for global manufacturers and operators of commercial unmanned aircraft systems

Access to safe, reliable maintenance will support commercial operations and urban mobility efforts

CHICAGO, June 4, 2019 /PRNewswire/ — Boeing [NYSE: BA] today announced its investment in Robotic Skies, a services provider that connects manufacturers and operators of commercial unmanned aircraft systems (UAS) with a global network of more than 170 civil aviation authority-certified repair stations.

The investment is part of Boeing’s disciplined, long-term strategy of entering into value-added partnerships that enhance and accelerate growth and deliver key differentiators for customers.

Boeing HorizonX Ventures led this funding round with participation from Thayer Ventures, Sun Mountain Capital and KickStart Seed Fund. The investment builds on a previously-announced collaboration with Robotic Skies, Boeing Global Services and its subsidiaries Aviall and Jeppesen to provide enhanced commercial UAS services.
