Barry Manilow is\u00a0suing\u00a0Princess Cruises<\/strong>. The lawsuit, filed back in March, alleges\u00a0that the cruise line is airing unauthorized\u00a0performances of Barry Manilow’s “Music and Passion Live<\/strong>“. <\/em>The suit claims that\u00a0Princess has repeatedly\u00a0broadcasting the Manilow\u00a0performance on the lido deck of its ships. The showings are alleged\u00a0to be a key\u00a0component of the cruise lines\u00a0entertainment package for\u00a0its customers, according to\u00a0the complaint.\u00a0The suit claims that\u00a0the Manilow trademark is being used without proper authorization. The entity filing the suit also named\u00a0Swank Motion Pictures<\/strong>\u00a0as a defendant\u00a0in the suit. Reportedly, Swank sold the\u00a0rights to broadcast “Music and Passion Live<\/strong>”\u00a0<\/em>without the\u00a0authority to\u00a0Princess Cruises, and other entities. Barry Manilow\u00a0is currently on his farewell concert tour, and the suit claims that the “unauthorized” rebroadcasts are hurting the performers\u00a0ticket sales. Suits of this nature are very difficult to win, because the defendant has to prove that the airings actually took place in U.S. Territorial waters. If the ship is in international waters at the time it’s shown, it is considered out of the jurisdiction of the United States.<\/p>\n

Princess Cruises released\u00a0a\u00a0statement in response to the suit:\u00a0“Princess Cruises licensed the Barry Manilow concert recording of ‘Music and Passion’ from OnBoard Movies (a division of Swank Motion Pictures, Inc.) in December 2010. Stiletto Entertainment, the company that had been previously assigned the rights to the content, claims that we did not have the rights to broadcast the Manilow concert onboard our fleet of cruise ships. Any disputes regarding licensing rights and fees are properly between Stiletto Entertainment and OnBoard Movies\/Swank Motion Pictures, Inc.”<\/p>\n

Barry Manilow sues “The Love Boat”<\/h2>\n

Princess Cruises was\u00a0famously portrayed in the 1970’s hit TV show “The Love Boat<\/strong>“.\u00a0The show\u00a0ran for 10 seasons, and featured many famous guest stars falling in love on the high seas.\u00a0The Cruise line was originally founded\u00a0in 1965\u00a0by\u00a0Stanley McDonald. He began by chartering a single ship from another cruise line,\u00a0Canadian Pacific Limited. The ship was named Princess Patricia<\/strong>, and offered Alaska cruises starting in the\u00a0Spring, and ending in the Fall. With the boat\u00a0sitting idle\u00a0for the winter months, Mr.\u00a0McDonald used the ship to offer cruises of the Mexican Riviera from Los Angeles.\u00a0Unfortunately, the ship was not\u00a0equipped\u00a0for tropical cruising, as it did not have any\u00a0air-conditioning.\u00a0In November of\u00a01967, Princess Patricia was replaced by the relatively new Princess Italia<\/strong>, which had been sub-chartered by Europe’s\u00a0Costa Line. She began a whole new era of Mexico cruises for Princess starting on December 15, 1967. The ship later was used to begin\u00a0Alaska cruises\u00a0sailing from San Francisco in 1969. The Alaska cruises\u00a0were canceled in 1973, and the Princess\u00a0Italia was returned to Costa. The next\u00a0charter ship to be\u00a0leased from Costa was the Carla C<\/strong>. This ship was then dubbed Princess Carla\u00a0<\/strong>by the cruise line, and it was on this ship that\u00a0Jeraldine Saunders would begin writing the first chapters of her famous\u00a0book\u00a0The Love Boats<\/strong>.\u00a0<\/i>The rest is history!<\/p>\n
